As former New Orleans Mayor Ray Nagin prepares to begin serving a 10 year prison sentence at a federal institution in Texarkana, Texas, his lawyer says Nagin is "indigent" and he's seeking court approval to withdraw from the case.

Robert Jenkins has asked Judge Ginger Berrigan to release him and appoint a public defender for Nagin's appeal since the ex-Mayor is unable to pay him.

In his motion filed in federal court, Jenkins wrote that Nagin is "indigent" and is unable to cover the costs associated with the appeal.

Nagin is scheduled to report to prison September 8 following his conviction earlier this year on federal corruption charges.
